This notice, provided pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (the “GDPR”) and Legislative Decree No. 196/2003 (the “Italian Privacy Code”), describes the processing of personal data connected with the consultation of the website www.immobiliaredanesi.it, with requests submitted to the Controller and with communications by email, including the purposes of the processing, the retention periods and the rights of the data subject. For cookies and similar tools, reference is made to the Cookie Policy.
The data controller is NCD Immobiliare S.r.l.s., which trades under the name Danesi Immobiliare (hereinafter the “Controller” or the “Company”).
The Controller has not appointed a Data Protection Officer, the conditions laid down in Article 37 GDPR not being met; for any request concerning the processing of personal data, the data subject may contact the Controller at the details indicated above.
Requests may be submitted through the forms on the website (Contact, property page, valuation, sale of the property), by email, by telephone, via WhatsApp or through the property portals.
Such data are not used for promotional purposes; with regard to emails containing property proposals, reference is made to section 5.
For sale or letting mandates, purchase offers and contracts, a specific notice is provided at the time of signing. In summary, the data processed are those necessary for the performance of the contract (Article 6(1)(b) GDPR) and those required by law, including identification for anti-money-laundering purposes (Article 6(1)(c) GDPR; Legislative Decree No. 231/2007). Such data are retained for 10 years from the termination of the relationship, in accordance with civil, tax and anti-money-laundering legislation.
Within the Company, the data are accessible only to the head of the agency and to authorised agents. Externally, the data may be communicated to the following recipients:

The website, the archive and the email service are hosted in Italy. Only the data processed through United States companies may be transferred outside the European Union:

The Controller adopts the following measures: encrypted connection (HTTPS), access to the management system through personal profiles and two-factor authentication, nightly backup copies overwritten within 14 days, and complete erasure upon request.
The provision of data is optional: browsing the website does not require any. In the forms, name and email address are required (for alerts, the email address alone), failing which it is not possible to respond; the telephone number is optional. For mandates and contracts, certain data are mandatory by law.
The Controller does not adopt decisions based solely on automated processing which produce legal effects concerning the data subject or similarly significantly affect him or her (Article 22 GDPR). The automated tools employed (anti-spam filter, selection of the properties to be proposed, artificial intelligence drafts) serve merely as support: decisions concerning the data subject are always taken by a natural person.
The website and the forms are intended for persons of full age. Any data of a minor received without the consent of the holder of parental responsibility are deleted.

Requests may be sent to info@immobiliaredanesi.it or to the PEC address ncdsrls@pec.it. The Controller replies free of charge within one month; in complex cases, that period may be extended by two further months, subject to notice to the data subject (Article 12(3) GDPR). Confirmation of the identity of the requester may be required.
In the event of erasure, the data are removed from the archive, from working files and from mailing lists. Only the following are retained: a code derived from the email address, which does not allow the address itself to be traced, in order to prevent its being re-entered in error, and the data whose retention is required by law.
A data subject who considers that the processing of his or her data does not comply with the applicable legislation may lodge a complaint with the Italian Data Protection Authority (“Garante per la protezione dei dati personali”), Piazza Venezia 11, 00187 Rome, www.garanteprivacy.it, or with the supervisory authority of the European Union Member State in which he or she resides or works.
Any amendments are indicated by the date of last update shown at the outset; substantive amendments are notified on the website or by email.

This Cookie Policy describes the cookies and similar tools (browser storage, “localStorage” and “sessionStorage”) used by the website www.immobiliaredanesi.it: the party installing them, their purposes, their duration and the means of making a choice. It is provided pursuant to Article 122 of the Italian Privacy Code and the Guidelines of the Italian Data Protection Authority (Garante per la protezione dei dati personali) of 10 June 2021. The data controller is NCD Immobiliare S.r.l.s.; the contact details and the rights of the data subject are set out in the Privacy Policy.
The internal visit counter (described in section 2 of the Privacy Policy), the typefaces, hosted on the Controller’s server (without any connection to Google Fonts), and the photographs of the listings, supplied by the servers of Immobiliare.it S.p.A. (Getrix) in Italy, likewise operate without cookies. For listings without photographs, an image supplied by the placehold.co service (Cloudflare network, United States) is displayed, which receives the user’s IP address.
Google and Microsoft may transfer such data to the United States on the basis of the safeguards of the Data Privacy Framework (section 8 of the Privacy Policy).
Maps, videos and virtual tours are supplied by third-party sites. In the absence of consent, a box with a button is displayed in place of such content; selecting the button causes only the content concerned to be loaded, limited to the page on which it appears.
The website does not use its own advertising cookies, social network pixels, sharing buttons that perform tracking, or techniques intended to recognise the user’s device over time or on other sites.
